How we process your personal data and use AI tools in the recruitment process.
Who controls your data
The controller of your personal data is Jagoda Wieczorek, running a sole proprietorship under the business name TalentED Jagoda Wieczorek. For anything related to your personal data, contact: ask@finders9.com.
Where your data comes from
We collected your data directly from you (through an application, a form or a conversation) or from publicly available professional sources, in particular LinkedIn and other professional databases, to the extent you published it there yourself.
Why we process your data and on what legal basis
- Running the recruitment process you are taking part in on behalf of our client, based on the consent you give by joining the process (Art. 6(1)(a) GDPR) and on our legitimate interest as a recruitment agency (Art. 6(1)(f) GDPR).
- Getting in touch with you about a role for the first time (sourcing), based on our legitimate interest (Art. 6(1)(f) GDPR) in finding candidates whose qualifications match the roles we are working on.
- Considering you for future recruitment processes, only with your separate consent (Art. 6(1)(a) GDPR).
- Establishing, pursuing or defending legal claims, based on our legitimate interest (Art. 6(1)(f) GDPR).
What data we process
We process professional data: your name, contact details, career history, education, qualifications and skills, expectations regarding the role, and information you share in your application documents and during interviews. We do not collect special category data (for example about your health, beliefs or family life), and we ask you not to include it in your application.
How we use AI in the process
- In line with Article 50 of Regulation (EU) 2024/1689 (the AI Act), we inform you that we use artificial intelligence tools in the recruitment process, among other things to assess how your experience matches the requirements of the role and to prepare interview summaries and materials for our client.
- Our key principle: AI tools only ever play a supporting role. Every piece of material prepared with their help is reviewed by a recruiter, and all decisions about your participation in the process (who we contact, who moves on to the next stage, who the client makes an offer to) are made by people. Your data is not subject to automated decision-making within the meaning of Art. 22 GDPR.
Recording interviews
Interviews may be recorded and transcribed so that they are documented accurately and assessed fairly. We will always let you know in advance, in the interview invitation. Recording is entirely voluntary: you can say no before the interview or at the start of it, in which case the interview goes ahead without recording and anything recorded up to that point is deleted. Saying no has no effect whatsoever on your participation in the process.
Who receives your data
- The client on whose behalf we are running the recruitment process you are taking part in (we will tell you who the client is during the process).
- Providers of the tools we use to deliver our services (the provider and where the data is processed are shown in brackets):
- Manatal (data hosted on Amazon Web Services in the USA): applicant tracking system (ATS).
- LinkedIn Recruiter (LinkedIn Ireland Unlimited Company, Ireland; data also processed in the USA): finding and contacting candidates.
- Dripify (data hosted on Amazon Web Services, with processing also outside the EEA): messaging on LinkedIn.
- Fireflies.ai (Fireflies.AI Corp., USA; data processed in the USA): recording and transcribing interviews.
- Claude (Anthropic, USA; data processed in the USA): AI-assisted analysis and support.
- Google Workspace, including Gemini (Google Ireland Limited, Ireland; data processed in Google data centers in the EU and elsewhere, including the USA): email, documents and AI support.
- Make (Celonis, Czech Republic; data processed in the EU): automatically passing data between the tools listed above.
- Cal.com (Cal.com, Inc., USA; data processed in the USA): scheduling interviews.
Transfers outside the EEA
Some of the tool providers we use are based in, or process data in, the USA. Such transfers rely on a European Commission adequacy decision (the EU-U.S. Data Privacy Framework) or on standard contractual clauses.
How long we keep your data
We process your data for as long as the recruitment process lasts and for 12 months after it ends, in case of any claims. If you agree to be considered for future roles, we keep it for up to 24 months from when you gave your consent, or until you withdraw it.
Your rights
You have the right to access your data, to have it corrected or erased, to restrict its processing, to data portability, to object to processing based on legitimate interest (including any further sourcing contact), and to withdraw your consent at any time, without affecting the lawfulness of processing carried out before withdrawal. You also have the right to lodge a complaint with the President of the Polish Personal Data Protection Office (UODO), ul. Stawki 2, 00-193 Warsaw, Poland.
To exercise any of these rights, email us at ask@finders9.com.
